Sign a venue hire agreement online

Signing a venue hire agreement online should lock in the date, the money and the rules that cost hirers their bond, before anyone books a band. This four page agreement for a Friday night 40th in a Ballarat function room has the hirer type the expected guest count, type an X under the noise limits and sign, then the venue's events manager countersigns, 39 days before the party.

6. What the Venue provides

  • Exclusive use of the spaces in clause 1 during the hire period.
  • An event supervisor on site from 5.00 pm to midnight, and licensed crowd controllers at a ratio of one to every 75 guests, as the liquor licence requires.
  • Bar staff holding responsible service of alcohol certificates. Only the Venue supplies and serves alcohol.
  • The house sound system, a microphone, and a lighting preset for dancing.
  • Cleaning after the event, and waste and recycling removal.

7. What the Hirer provides

  • A responsible adult, the Hirer or a person named in writing, present for the whole hire period.
  • Their own caterer, who must hold a current food business registration and public liability insurance, and give the Venue copies by Friday 30 October 2026.
  • Any band, DJ or entertainer, who must follow clause 9 and the event supervisor's directions.
  • Decorations that are free standing. Nothing is fixed to walls, ceilings or heritage fittings, and no confetti, glitter, smoke machines, open flames or sparklers are used.

8. Guests and conduct

The Hirer is responsible for the conduct of every guest. Guests under 18 are permitted only with a parent present and are never served alcohol. The event supervisor or crowd controllers may refuse entry to, or remove, any guest who is intoxicated, violent or unsafe, and may end the event early if the safety of guests or staff requires it, in which case no refund is due.

9. Noise limits

Merriwell House is in a mixed use street with apartments next door and opposite. Music from licensed venues in Victoria must not be unreasonable for neighbours, and the Venue's licence and its agreement with its neighbours set the limits below. The event supervisor monitors levels with a sound meter during the event.

ConditionLimit
Amplified music inside the Gaslight RoomNo louder than 90 decibels measured at the mixing desk
Music in the courtyardNone after 8.00 pm. Courtyard closes at 10.00 pm
Doors and windowsKept closed when music is playing, except to come and go
Music off11.00 pm, without exception
Guests leavingAsked to leave quietly; taxis and rideshare collect from the Lydiard Street entrance

If a level is exceeded, the event supervisor asks the performer or the Hirer to turn it down. A second request is recorded. After a third, the supervisor may turn off the music. A fine, a call out fee, or the cost of an official noise complaint resulting from the event comes out of the bond under clause 4.

To show that the noise conditions have been read and accepted, the Hirer types an X in the box below. The agreement cannot be completed without it.

XAcknowledgement
I have read the noise conditions in clause 9 and will make sure my performers and guests follow them.

10. Damage and insurance

The Hirer is responsible for damage to the Venue caused by the Hirer, their guests or their suppliers. The Venue holds public liability insurance for the building and its own staff. The Hirer's suppliers hold their own. The Hirer is encouraged to consider event insurance for their own losses, such as a cancellation forced by illness.

11. Access and accessibility

The Gaslight Room is on the ground floor with a level entry from the courtyard and an accessible toilet. Suppliers load in through the rear laneway from 5.00 pm, and parking in the laneway is for loading only.

12. Emergencies

The event supervisor is the warden for the event. In an emergency every guest follows the supervisor's directions and leaves by the nearest exit to the assembly point in the front garden. The Hirer is shown the exits, the fire equipment and the assembly point at a walkthrough before guests arrive.

13. Privacy

The Venue keeps the Hirer's contact and payment details to manage the booking, and keeps CCTV footage of entrances and the bar for 30 days. The Venue does not photograph the event or use images of it without the Hirer's written agreement.

14. General

This is the whole agreement for the booking. A change to the date, hours or spaces is agreed in writing. Nothing in it limits the Hirer's rights under the Australian Consumer Law. It is governed by the law of Victoria.

15. Signatures

The Hirer signs first. The Venue's events manager countersigns, and the booking is then confirmed for Friday 13 November 2026 once the deposit is received.

The signing journey

  1. Step 1

    Five fields across four pages

A guest count on page 1, a noise box on page 3, a signature and date on page 4 for the hirer, and a four line block for the venue.

  2. Step 2

    The hirer types the number

Anton types the guest count the venue will roster to. It must sit within the 120 standing capacity printed beside it.

  3. Step 3

    Noise terms need an X

The noise box is required. Anton types an X next to the statement that his performers and guests will follow clause 9.

  4. Step 4

    Countersigned well ahead

Sign in order is on. Phoebe signs after Anton, and both signatures are stamped Oct 5, 2026, 39 days before Friday 13 November 2026.

Every field, and who fills it

Anton Vellacott types the expected guest count on the ruled line under clause 2 on page 1, types an X in the noise acknowledgement on page 3, and signs page 4 with a stamped date. Phoebe Strand's block beside him prints FOR MERRIWELL HOUSE EVENTS PTY LTD, her name, the Title and Company she types, and the date. The $2,400.00 room hire, the $800.00 deposit, the $1,600.00 balance and $500.00 bond due on Friday 30 October 2026, and the noise table are printed.

How to adapt this envelope

A hirer booking for a company adds a block for themselves with Title and Company instead of a plain signature. A venue that wants the caterer's insurance confirmed in the same envelope can add the caterer as a third signer with a checkbox. A venue without close neighbours can turn the noise box optional, or drop it and keep the clause.

What makes this valid in Australia

The Electronic Transactions Act 1999 and the Victorian equivalent accept an electronic signature that identifies the signer and shows intention reliably. A private hirer is a consumer, so the Australian Consumer Law guarantees apply to the hire whatever the agreement says, and Victorian environment protection rules on music noise sit behind the limits in clause 9.

What makes this signing flow work

The guest count comes from the hirer

Bar staff and crowd controllers are rostered to the number of guests, at one controller to every 75. When the hirer types the estimate himself, the signed copy shows what the venue was told, which matters if more people arrive than were planned for.

An X beside the clause that costs bonds

Noise is the most common reason a bond is not returned in full. A required checkbox directly under the limits, with the 11.00 pm music off time in the table above it, means the hirer cannot reach the signature without acknowledging them.

Signed long before the deposit matters

The booking is held only when both have signed and the $800 deposit is paid. Completing the envelope 39 days out gives the hirer time to pay, and puts the cancellation terms in force while he still has more than 30 days' notice to use.

Questions people ask

Is an online venue hire agreement as binding as a paper one?

Yes, when the signature identifies the person and shows they agreed, which Australian electronic transactions law accepts. The certified PDF cannot be altered after completion, and the certificate records both signers' emails, IP addresses and signing times, which is stronger evidence than a scanned page.

Can the hirer and the venue sign without meeting?

Yes. The hirer's link arrives by email, he signs in a browser on any device, and the venue's events manager is invited automatically once his signature is stamped. Neither needs an account, and the certified copy is emailed to both of them when the second signature lands.

How long does the hirer have to sign the venue agreement?

The link stays valid for 30 days from when the envelope was created, a period the venue cannot change in the app. The agreement's own rule is stricter in practice: clause 3 lets the venue release the date if the deposit is not paid within three business days of signing.

What if the hirer declines to sign?

The envelope moves to declined and the venue is emailed with the reason he gave. The events manager is never invited and nothing is stamped, so the date is not held. The venue can talk it through, withdraw the envelope, and send a revised agreement.

Can the hirer change the guest count after signing?

The signed copy keeps the estimate he typed. Clause 2 asks him to confirm the final number by Friday 30 October 2026, which he does by email, and it may not exceed the 120 capacity on the venue's occupancy permit.

What comes out of the bond if the music runs late?

Clause 4 lets the venue deduct extra staff time after 11.30 pm at $90.00 an hour, and clause 9 adds any fine or call out fee caused by noise, each itemised in writing. The rest of the $500.00 is returned within 10 business days.
