How long should a lease be?

A residential lease is usually 6 or 12 months, a retail shop lease 5 years with an option to renew, and equipment or a venue is hired by the day or hour. Across 13 lease, licence and hire examples counted here, the term runs from a few hours to five years plus five more, and the short ones end on 14 days notice.

A lease should be as long as the tenant needs the place and the owner is willing to commit: in practice 6 or 12 months for a home, 5 years with an option to renew for a retail shop in Victoria, a few years for farmland or a vehicle, and periodic, ending on a couple of weeks notice, for a room, a storage unit or a desk. The 13 lease, licence and hire examples on this site follow exactly that spread.

What was counted

The set is every lease, licence and hire document in the document example library on this site on 21 October 2026: 13 documents for fictional Australian owners and tenants, from a five year retail shop lease to a single evening’s venue hire. Each was read by hand for its term, any renewal or option, how it ends and what security is held, because these are written in prose and tables rather than in one field.

The examples were written to be complete for their situation, so they show what each kind of arrangement normally commits to. They are not legal advice, and the law that sets minimum terms and notice differs by state.

Long terms: shops, farms and vehicles

The longest is the retail shop lease for a barbershop in Fitzroy, Victoria: five years from 1 March 2027, an option for one further five years, rent of $48,000 in year one rising 3% a year, and a security deposit. Five years is not an accident. Victoria’s Retail Leases Act gives a retail tenant a five year minimum term, and the Victorian Small Business Commission explains that a shorter term needs a waiver certificate it can issue at the tenant’s request.

The farm lease runs three years, with a commitment to talk about three more by a set date and a first right for the lessee to match any other offer for the land. The vehicle lease runs 24 months with no automatic renewal, and either party can propose a new lease in the final two months. Long terms like these reward an investment: a fit out, pasture improvement or a business built around the van.

Fixed terms of a year or less

The residential tenancy in Summer Hill, NSW, is a 12 month fixed term with a bond of four weeks rent. The rent to own agreement runs 52 weeks with an option to buy for $8 at the end. The sublease runs eight months and cannot outlast the head lease it sits under; if the head lease ends early, so does the sublease. A fixed term gives both sides certainty about the rent and the dates, and the room rental against lease page explains how the type of arrangement changes the rules.

Periodic arrangements

Four examples have no fixed end at all. The room rental runs week to week and ends on two weeks written notice; the storage unit runs month to month on 14 days notice; the coworking licence to occupy and the horse agistment both end on 14 days notice. Periodic terms suit arrangements where either side may need to leave at short notice and nothing large has been invested.

Hire by the day or the hour

The last three are hires: four days of equipment with daily and then weekly rates, a holiday rental for the stay, and a venue for one evening from bump in to bump out. Their documents spend their words on the condition of the thing hired, the bond and what happens if it is returned late, not on term.

Choosing a term

  1. Home: 6 or 12 months fixed, then periodic under the state’s tenancy law.
  2. Retail shop in Victoria: 5 years unless the tenant obtains a waiver, often with a 5 year option.
  3. Farmland, vehicles, equipment on long hire: 2 to 3 years, matched to the investment.
  4. Rooms, storage, desks, agistment: periodic, with 14 days or two weeks notice.
  5. Events and equipment: the hire period, defined to the hour.

Each lease’s clauses are covered in the clause library, such as the break lease clause and the guarantor clause, and contract statistics counts the clauses in these and the other agreements.

In the product

The document generator writes a lease or hire agreement from a description, classified as a legal document with numbered clauses, a table for the particulars and a signature block for each party, and the document can then be sent for e-signature with one signer per block. The AI chat edits the text afterwards. The numbered clauses page shows the layout, and the guide to creating a document with AI covers the brief.

A finished example

A retail lease is decided by three numbers and two clauses: the rent, the review, the outgoings, the fit out contribution and the make good. This 12 page Victorian lease sets all five out in the open, including the outgoings the landlord is not allowed to recover at all.

Questions people ask

Is a 12 month lease standard for a rental home?

It is the most common fixed term for Australian homes, and the residential tenancy example here is 12 months. Six month terms are also common. When a fixed term ends without a new one, most agreements continue as a periodic lease under the state tenancy law until someone gives notice, so the term mostly decides how long the rent and the tenancy are locked in.

What is the minimum term for a retail lease in Victoria?

Five years. The Victorian Small Business Commission explains that if a tenant asks for a shorter term, it can issue a five year waiver certificate, which is how a shorter term becomes valid. The Victorian shop lease example here runs five years with an option for five more, the common five plus five arrangement.

What is an option to renew?

A right, usually the tenant's, to extend the lease for a further term on terms set out in advance, exercised by notice within a window before expiry. The retail lease example gives one further five year term. Options suit businesses that spend money fitting out a shop and need time to earn it back.

Should a short arrangement be a lease or a licence?

If the person gets a defined space to themselves for a set term, it usually behaves like a lease; if they share space and can be moved, a licence fits better. The coworking example here is a licence to occupy with no fixed term and 14 days notice either way. Get advice where the difference matters, because statutes treat them differently.

How much notice ends a periodic arrangement?

Whatever the agreement and the law set. The periodic examples here use two weeks for a room and 14 days for a storage unit, a coworking desk and horse agistment. For a residential tenancy, state tenancy law sets the minimum notice for each party and reason, and the agreement cannot shorten it.
