End of employment during probation, Quayside Hotel Group

Failed probation letter with reasons, notice and final pay

A failed probation letter ends employment during probation, gives the reasons, and sets out the notice the contract requires and the final pay. This one page letter from a hotel group ends a front office supervisor's employment in month five, tying the decision to two recorded reviews and paying a week in lieu.

Mr Nathan Price, Front Office Supervisor

Outcome of your probation

Dear Nathan, thank you for meeting with me today. As discussed, your probation has not been successful and your employment with Quayside Hotel Group will end. You started on Tuesday 14 April 2026 on a six month probation, which this letter ends in its fifth month.

The reasons. At your first review on Tuesday 14 July we agreed two areas to improve: closing the night audit by 2 am, and completing the shift handover log. At your second review on Tuesday 11 August, the night audit had closed after 2 am on 9 of 16 shifts, and the handover log was incomplete on 6 occasions, including the 3 August room move that led to a guest complaint. Since then there has been no lasting improvement.

When dismissal protection starts

Probation is a contractual idea, while protection from unfair dismissal is set by law, and the two do not always line up. In Australia the Fair Work system sets a minimum employment period, six months for most employers and twelve for small businesses, before most unfair dismissal claims are possible. In the UK the general qualifying period has been two years. In most US states employment is at will. In every case, protection from discrimination, and from dismissal for raising a workplace right, applies from the first day. A probation letter that ties its reasons to documented reviews is the best defence against a claim that the real reason was something else.

Probation rules in three systems

Australia: probation is common, the minimum employment period runs alongside it, and notice follows the National Employment Standards or the contract if longer. UK: probation periods are common and often allow shorter notice, but statutory minimum notice of one week applies after a month of service. US: probation has little legal effect in at will states, though it can matter under union agreements and in public employment. Whichever applies, the letter should name the clause it relies on for notice and set out final pay in full.

How to adapt this document

Change the dates, role and reviews, and use your own review records for the reasons; if there were no documented reviews, reconsider whether the decision is fair before sending. Set notice from your contract and check it against the statutory minimum. List every final pay item, including leave, and the date they will be paid. If the employee will work out notice rather than be paid in lieu, replace the last day paragraph with the final working date and how handover will happen.

What makes this document work

Reasons trace back to the reviews

The decision rests on two dated reviews, 14 July and 11 August, with the two areas agreed at the first and the results at the second: the night audit late on 9 of 16 shifts, the handover log incomplete 6 times. Nothing in the letter is new to the employee.

Notice follows the contract clause

One week of pay in lieu of notice is tied to contract clause 4.3, and the final pay table lists hours worked, notice and 6.2 days of accrued leave with the pay run date. The employee can check each item against the contract and payslip.

The practical close is covered

The access card and two uniform sets go back to reception, against a receipt, and the separation certificate is promised within 7 days. Clear logistics keep the last day short and dignified.

Questions people ask

Do you have to give a reason for failing probation?

In many places there is no legal duty to give one, but a short, honest reason tied to reviews the employee already had is fairer and lowers the risk of a claim that the real reason was discriminatory. Keep it to the standards that were set and the evidence. Avoid new criticisms the employee never heard during probation.

How much notice is needed during probation?

Whatever the contract or applicable agreement says, but not less than any statutory minimum. Probation clauses often set a short notice period, such as one week. Notice can usually be paid in lieu if the contract allows. Check the minimum that applies in your jurisdiction, because a contract cannot give less.

Can an employee appeal a failed probation?

Only if the employer's policy offers an appeal; there is usually no legal right to one. Some employers offer a short appeal to a more senior manager, which can catch mistakes. Separately, an employee who believes the real reason was discriminatory, or a protected complaint, may have a legal claim whatever the probation status.

When does protection from unfair dismissal start?

It varies by country. In Australia most employees need six months of service, or twelve with a small business employer, before an unfair dismissal claim is open. In the UK the qualifying period has generally been two years. In most of the US, employment is at will. Discrimination protections usually apply from day one everywhere.

Should a failed probation be told in person?

Yes, in a short private meeting, then confirmed in writing the same day. Offer the employee a support person if your policy allows. Have the final pay figures ready so the conversation can cover practical questions, and agree how they will collect personal items or return property without an awkward walk through the workplace.
