Show cause letter, Grace Mwangi, Barrowfield Shire Council

Show cause letter template with three dated allegations and a deadline

A show cause letter asks someone to answer before anything is decided, so it has to state what is alleged precisely enough to answer and say clearly that no finding has been made. This one numbers three allegations with their dates, lists the four documents relied on, and gives five business days to respond.

Show cause: three allegations, response due 9 October 2026

Dear Grace, Council has completed a preliminary inquiry into three matters raised on 21 September 2026. This letter sets out the allegations, tells you what you may look at, and asks you to show cause why disciplinary action should not be taken. No finding has been made and no decision has been reached.

1
The allegations
Each allegation is stated with the date and the conduct alleged, so that your response can deal with them one at a time.
No.
Date
What is alleged
One
14 and 28 August, 11 September 2026
Council fuel card 4417 used for fuel in a private vehicle, three times, totalling $268.40
Two
3 September 2026
A quotation approved from a business in which an immediate family member holds an interest, with no declaration made
Three
16 September 2026
A ratepayer name, address and payment history sent to a personal email account
2
What the allegations could amount to
If any allegation is made out, it may be a breach of the employee code of conduct, of the conflict of interest procedure, and, for allegation three, of the information privacy principles in the Privacy and Data Protection Act 2014 (Vic). Serious misconduct may lead to termination of employment. Whether any of that follows depends on your response and on the findings.
The material Council relies on
Fuel card statements for July to September 2026, with the three transactions marked
Fleet booking records for 14 and 28 August and 11 September 2026
The quotation approved on 3 September and the supplier register entry
The mail gateway log for 16 September 2026, with the message header
3
What you are asked to do
Respond in writing to each allegation by 5 pm on Friday 9 October 2026, which is five business days from today. Say whether you agree with each one, give your account of what happened, and raise anything you want taken into account. You may also respond at a meeting instead, or as well.
If no response is received by 5 pm on 9 October
Council may make findings on the material listed above without your account. Ask for more time before the deadline if you need it. A request for a reasonable extension, in writing, will not be held against you.
4
A meeting, and a support person
A meeting is offered on Thursday 8 October 2026 at 10 am in the Barrowfield Square meeting room, or at another time that suits. You may bring a support person or a union representative to it, and you may bring one to any later meeting about this matter.
5
While this is being decided
You are on paid leave from today until the matter is finished. This is not a disciplinary step and it is not a finding. Your access to the fuel card and the supplier system is suspended for the same period. Keep this letter and the material confidential while the process runs.

Send your response to people@barrowfield.vic.example or to me in person. Call me on 03 5470 1214 if anything in this letter is unclear. Yours sincerely,

Hana Whitfield, Manager People and Culture

How to adapt this document

For a single allegation, drop the table and set it out as a numbered clause with the date, the conduct and the source of the information. For a matter involving a complainant, remove detail that would identify them where that is possible, say why it is withheld, and be ready to give more if the employee cannot answer without it. For a private sector employer, replace the code of conduct and the state privacy Act with the policy actually relied on, and check whether the enterprise agreement or contract sets its own disciplinary steps and timeframes.

Which law the terms follow

The artifact is written for a Victorian council as an employer. The procedural shape, allegations put in writing, the material identified, a real opportunity to respond, a meeting offered and a support person allowed, follows what the Fair Work Act 2009 treats as relevant to a fair dismissal, and the Fair Work Commission's benchbook collects how those criteria are applied. Allegation three is framed against the information privacy principles in the Privacy and Data Protection Act 2014 (Vic), which bind Victorian public sector organisations including councils rather than the federal principles. The code of conduct sits under the Local Government Act 2020 (Vic).

What makes this document work

Each allegation can be answered on its own

Fuel card 4417 used in a private vehicle on three dates totalling $268.40, a quotation approved on 3 September from a business a family member has an interest in, and a ratepayer's details sent to a personal email on 16 September. Numbered, dated, and specific enough that yes or no is possible.

The evidence is listed before the response is asked for

Fuel card statements with the three transactions marked, fleet booking records for the same dates, the quotation and the supplier register entry, and the mail gateway log. Asking someone to answer material they have not seen is the flaw that undoes a process later.

Paid leave is labelled as not a finding

Clause 5 says the employee is on paid leave until the matter is finished, that this is not a disciplinary step and not a finding, and that fuel card and supplier system access is suspended for the same period. Saying what the step is not is what stops it being read as a verdict.

Questions people ask

What is a show cause letter?

A letter that sets out allegations and asks the employee to show cause why disciplinary action should not be taken. It is a step in a process rather than a decision, which is why this one says in its opening paragraph that no finding has been made and no decision reached.

How long should the employee be given to respond?

Long enough to read the material and get advice. Five business days is common for a matter of this size and is what this letter gives, to 5 pm on Friday 9 October. The letter also invites a request for more time in writing and says it will not be held against the employee.

Does the employee get a support person?

They should be offered one for any meeting about their employment. This letter offers a meeting on Thursday 8 October and says a support person or union representative may attend that meeting and any later one. Unreasonably refusing a support person weighs against an employer if a dismissal is later assessed.

What happens after the response?

The decision maker considers the response, makes findings on each allegation, and only then decides whether any action follows. The response has to be genuinely considered rather than filed, and a decision written before it arrives is the defect most often found.

Can a show cause letter lead to dismissal?

It can, and the letter should say so rather than leave it as a surprise. Clause 2 here says serious misconduct may lead to termination of employment and then says whether any of that follows depends on the response and on the findings, which is the honest version of both halves.
