Final written warning, Tyrone Beckett, Marlow Lane Espresso

Final written warning template that lists every warning already given

A final warning is only final if the record shows what came before it, and most fail because the earlier steps were verbal and undated. This one lists three prior warnings with dates and who gave them, four dated late starts since the last one, the response given at the meeting, and the consequence in a single sentence.

What has happened since 20 July
The second written warning set the same standard this letter sets. Since it was given you have opened four times after your rostered start, and on two of those the shop opened late to customers.

The meeting and what you said
You were told the purpose of the meeting in writing on 30 September and offered a support person, which you declined. At the meeting on 2 October you said the 5:45 am starts are hard after a late close the night before, and that two of the four dates followed a close after 11 pm.
3
What was decided, and what was done about it
Your response was accepted in part. From 12 October you are not rostered to open the morning after a close later than 10:30 pm, and the Friday roster changes to give you a 7 am start. That removes the reason you gave. The warning still stands, because notice was not given on three of the four dates.
The standard from today
Be at the counter ready to work by your rostered start time on every shift. If you are going to be late, phone the duty manager before the start time, not after it. This is the same standard that applies to everyone who opens.
4
Consequence
If you do not meet that standard, your employment may be terminated. This is the last warning you will be given about attendance.
5
Review and support
Attendance is reviewed weekly for 12 weeks to 29 December 2026, and we meet on 30 December to close the review. You may bring a support person of your choosing to that meeting or any other, which is what the Fair Work Act 2009 expects of us, and you may raise anything about the roster with Elena Marlow at any time.

Acknowledgement
I have received this letter and had it explained to me. I understand that signing does not mean I agree with what it says, and that I may write my own comments below or send them later.

How to adapt this document

For a final warning about performance rather than conduct, replace the incident table with targets against results over the same period, keep the date column, and set the review at one full work cycle. For a single serious incident with no history, remove the prior warnings table and put the investigation steps and dates in its place, because the record that carries the letter is then the process rather than the pattern. Where an enterprise agreement or a disciplinary policy applies, name the step being used and any right of review it gives.

Which law the terms follow

The artifact is written for an Australian employer. The shape of the letter follows what the Fair Work Act 2009 treats as a fair process before dismissal: a valid reason, notification of it, an opportunity to respond, and no unreasonable refusal of a support person, which clause 5 offers in writing. The Fair Work Commission's unfair dismissal benchbook collects how those criteria have been applied, and for an employer with fewer than fifteen employees the Small Business Fair Dismissal Code sets out the warning and opportunity to improve this letter records. Nothing here promises an outcome at the Commission.

What makes this document work

The warning history is a table with four columns

A verbal warning noted on file on 3 February, a first written warning on 4 May, a second on 20 July, each with who gave it and the review period agreed. Naming the manager and the review length turns the history from a claim into a record someone else can check.

The employee's explanation is accepted in part, in writing

He said 5:45 am starts are hard after a late close and that two of the four dates followed a close after 11 pm. From 12 October he is not rostered to open after a close later than 10:30 pm and the Friday start moves to 7 am. The warning still stands because notice was missing on three of four dates.

The consequence is one sentence, and then it stops

If you do not meet that standard, your employment may be terminated. This is the last warning you will be given about attendance. Two short sentences with no hedging, which is exactly what makes them readable as a warning rather than as a threat.

Questions people ask

How many warnings before a final one?

There is no fixed number in Australian law. What matters is whether the employee knew the standard, knew they were falling short and had a real chance to improve. This letter shows three earlier steps over eight months, which is the pattern a tribunal recognises rather than a rule it enforces.

Should the employee be offered a support person?

Always, and in writing before the meeting. Unreasonably refusing a support person counts against an employer when a dismissal is assessed. This letter records that the purpose was given in writing on 30 September, that a support person was offered and declined, and that the offer stands for every later meeting.

How long does a final warning last?

As long as the letter says, and an indefinite warning is hard to rely on. Here attendance is reviewed weekly for twelve weeks to 29 December with a closing meeting on 30 December. Fixing an end date also gives the employee something to reach, which is the point of a warning.

Can an employer dismiss straight after a final warning?

Only after another instance of the conduct and another chance to respond. A final warning sets the standard, it does not pre approve the dismissal. The next step is a meeting about the new incident, with the response considered before any decision is made.

What if the employee refuses to sign?

Note refused to sign with the date on the letter, keep a copy and move on. The acknowledgement here says signing does not mean agreement and offers a comments line, which is what makes most people willing to sign. A refusal does not make the warning invalid.
