Model release, Harbour Mist campaign

Model release template with uses allowed and uses excluded

A model release is only as good as its two lists: what the photographs may be used for, and what they may never be used for. This one covers a skincare campaign shoot, runs for three years worldwide for $400, and rules out political advertising, alcohol and gambling, medical claims, stock libraries and training a system on the model's likeness.

1. What the Model agrees to
1.1
The material, and the uses allowed
The Model consents to the Photographer and Harbour Mist Skincare using the photographs and video from the session in the ways below. The Photographer owns the copyright in the material, and this release is permission to use her likeness in it.
Harbour Mist packaging, in store display and printed material.
The Harbour Mist website, email and owned social accounts.
Paid advertising online and in print, for the term.
The Photographer’s portfolio, website and award entries.
2. What is excluded
2.1
Uses this release does not cover
None of the following is permitted, and no fee buys it.
Political advertising or campaigning of any kind.
Advertising alcohol, gambling, tobacco, vaping or weapons.
Any claim that a product treated a medical condition.
Sale or licensing of the frames to a stock library.
Use of the material to train a system that generates her likeness.
3. Term, payment and control
3.1
Term, territory and fee
The release runs for three years from 4 March 2027 and applies worldwide. The fee is $400, payable within seven days of the session, and is the whole payment for the uses above.
3.2
Retouching and the two frame veto
The material may be cropped, colour graded and retouched in the ordinary way, but not altered to change the Model’s body shape or composited into a scene she was not in. She may veto two frames within five days of seeing the selects, for any reason.
3.3
Withdrawing consent
The Model may withdraw consent in writing at any time. No new use is then made of the material and it comes off owned channels within 30 days, but printed material and booked advertising may run out because they cannot be recalled.
3.4
If the Model is under 18
A model under 18 does not give this consent alone. A parent or guardian signs with her below and the fee is paid to the guardian, and the rules that apply to a child on a commercial shoot still apply.

Clauses in this document

How to adapt this agreement

For an editorial shoot, cut the release right back: editorial use usually needs no release at all in many places, and asking for a broad commercial one can stop a subject signing anything. For a campaign that may be extended, add a renewal rate now, so a brand that wants a second year is not renegotiating from zero with an image already in market. For a shoot with several models, keep one release per person rather than a group form, because withdrawal, fees and vetoes are personal and a shared form makes each of them ambiguous.

Where a release stops working

A release is permission from the person in the frame, and it settles less than people assume. It gives no ownership of the photographs, which stay with the photographer. It cannot be given by anyone under eighteen, so a parent or guardian signs and the release should say so. It does not cover a use the person would not have expected, which is why the excluded uses list matters more than the permitted one. And it rarely survives a context that suggests something untrue about the person, because the release permits use of a likeness, not a statement about them. Withdrawal, where it is allowed at all, cannot reach material already published.

What makes this document work

Two lists, and the second one is not negotiable

Five allowed uses run from packaging to the photographer's own portfolio. Five exclusions cover political advertising, alcohol and gambling, medical claims, stock libraries and training a system to generate her likeness, and the clause says plainly that no fee buys them.

The model keeps a small, workable veto

Two frames, vetoed within five days of seeing the selects, for any reason. It costs the shoot almost nothing and gives the model the one thing releases usually deny her: a say in which pictures of her go out, without handing her approval over the whole campaign.

Withdrawal is honest about what cannot be undone

Consent can be withdrawn in writing at any time. New uses stop, owned channels come down within 30 days, and printed material and booked advertising run out because they cannot be recalled. A release that promised full withdrawal would not survive contact with a print run.

Questions people ask

What is a model release?

A signed permission from the person in a photograph for their likeness to be used in stated ways. The photographer owns the copyright in the image; the release is what allows the person in it to appear in a commercial context. Without one, most brands will not run the picture.

What should a model release include?

The session and the material it covers, the uses allowed, the uses excluded, the territory and the term, the fee, what retouching is permitted, whether consent can be withdrawn and what happens if it is, and a signature block. A separate line for a parent or guardian is needed where the model is under 18.

Does a model release have to be paid?

It needs consideration to be binding as a contract, and a fee is the simplest form of it. Here the model is paid $400 within seven days of the session, and that payment is stated to be the whole payment for the uses listed, however often the campaign runs during the three year term.

Can a model withdraw consent later?

Under this release, yes, in writing at any time. From that point no new use is made, and the material comes off owned channels within 30 days. Printed material and advertising already booked may run out. That split is what makes the promise realistic rather than aspirational.

What happens if the model is under 18?

A parent or guardian signs with them in the same block and the fee is paid to the guardian. The release also records that the rules applying to a child on a commercial shoot still apply, since a signature does not override the permits and supervision requirements that sit behind them.
