Apprenticeship Agreement, Sparkline Electrical

Apprenticeship agreement template with a training plan and wage progression

An apprenticeship agreement template sets out the employment terms that sit alongside the government training contract: what the apprentice learns each year, what they are paid at each stage, who supervises them and how probation works. For an apprentice under 18 a parent signs too, so this one carries three signatures.

1. The apprenticeship
1.1
What this agreement is
The Apprentice is employed full time to train for UEE30820 Certificate III in Electrotechnology Electrician. This agreement sets out the employment terms. It sits alongside the training contract, which the parties sign in the form the Victorian Registration and Qualifications Authority approves and which is lodged through an Apprenticeship Network Provider. If the two documents differ, the training contract prevails.
1.2
Term
The apprenticeship starts on Monday 11 January 2027 and is expected to take four years. It ends when the Apprentice completes the qualification and the training contract is completed, which may be earlier or later than four years depending on progress.
1.3
Registered training organisation
Off the job training is delivered by Goldfields Trade Institute, RTO 41587, at its Bendigo campus. The Employer enrols the Apprentice within the time the Authority requires, and pays the course fees, which are not recovered from the Apprentice.
2. Training plan by year
2.1
The plan
The Employer, the Apprentice and the RTO agree a training plan in the first weeks of the apprenticeship. Its outline is below; the RTO’s plan sets the units in detail.
Year
Off the job, at the RTO
On the job, with the Employer
Year 1
Safety, electrical principles, hand and power tools; three blocks of two weeks
Site safety, cable pulling, conduit and fixing under direct supervision
Year 2
AC circuits, wiring rules, final subcircuits; three blocks of two weeks
Domestic wiring, switchboard fit off, testing with a licensed electrician
Year 3
Motors, three phase, fault finding; two blocks of two weeks
Commercial installations and fault finding under general supervision
Year 4
Verification, capstone assessment and the licensed electrician assessment
Testing and verification of whole installations before sign off
2.2
Time for training
Days at the RTO are paid working days. The Employer releases the Apprentice for every scheduled block and allows reasonable time on the job to complete the logbook, which a supervisor signs off each fortnight.
2.3
Progress reviews
The Employer, the Apprentice and the RTO review progress every six months. The Apprentice moves to the next wage stage at the anniversary of the start date, or earlier if the RTO confirms the competencies for that stage have been achieved.
3. Wages
3.1
Wage progression
The employment is covered by the Electrical, Electronic and Communications Contracting Award 2020 [MA000025]. The Employer pays the hourly rates below for ordinary hours, and never less than the Award rate for the Apprentice’s stage and age, which rises with each annual wage review.

3.2
Allowances and superannuation
The Employer pays the tool and travel allowances the Award sets for apprentices, and superannuation at the rate the law requires, currently 12 per cent. Each payslip shows the stage and the rate paid.
4. Supervision and safety
4.1
Who supervises
The Apprentice works only under the supervision of a licensed electrician employed by the Employer. The nominated supervisor is Daniel Kerr, electrician licence 31744, and in his absence another licensed electrician the Employer names that day.
4.2
Levels of supervision
In the first year supervision is direct, with the supervisor working alongside. Supervision moves to general only as the Apprentice is assessed competent in a task, and never for live work, which the Apprentice does not do at any stage.
4.3
Safety
The Employer provides site inductions, protective equipment and tested tools, and complies with the Occupational Health and Safety Act 2004 (Vic). The Apprentice follows safety directions, wears the equipment provided and reports any incident or near miss the same day.
5. Hours and leave
5.1
Hours
Ordinary hours are 38 a week, 7.00 am to 3.30 pm Monday to Friday. The Apprentice is not required to work overtime that would stop them attending training, and is not rostered alone on any site.
5.2
Leave
The Apprentice receives annual leave, personal and carer’s leave and every other entitlement under the National Employment Standards and the Award. Annual leave is not taken during an RTO block.
6. Tools, travel and conduct
6.1
Tools
The Employer supplies the test instruments and power tools. The Apprentice keeps the hand tool kit listed in the RTO’s first year requirements, and the Employer reimburses up to $600 of its cost in the first year on receipts.
6.2
Getting to sites and training
Until the Apprentice holds a full licence, the supervisor drives the Apprentice from the depot to each site in a company vehicle. Travel to the RTO campus is the Apprentice’s own, with the Award travel allowance paid for block weeks.
6.3
Conduct
The Apprentice follows reasonable directions, the Employer’s drug and alcohol policy and customer site rules, and keeps customer information private. Any concern about conduct is raised first with the Apprentice and, while the Apprentice is under 18, with the parent.
7. Probation and ending the apprenticeship
7.1
Probation
The first three months are the probationary period recorded on the training contract. During it either the Employer or the Apprentice may cancel the training contract, as the Authority’s rules allow, and the employment ends with it.
7.2
After probation
After probation, the training contract can only be cancelled or suspended as the Authority’s rules allow, and the employment can only end with notice under the National Employment Standards. Before either party seeks to end it, the parties meet with the Apprenticeship Network Provider to try to resolve the problem.
7.3
On completion
When the training contract is completed, the Apprentice becomes a qualified tradesperson. The Employer will tell the Apprentice at least three months before the expected completion date whether a role as a licensed electrician is offered.

Signing. Each party signs below. The parent signs to consent to the agreement and to support the Apprentice’s attendance at training while the Apprentice is under 18.

How to adapt this document

For an apprentice over 18, remove the parent party and the parent signature block, and check whether the award sets adult apprentice rates that are higher than the junior rates in the table. For a trade other than electrical, replace the supervision clause with that trade's licensing rule and rewrite the training plan from the qualification's units, keeping one row per year. For a school based apprenticeship, add the school as a party to the training plan, reduce the hours to the days agreed with the school, and note the school representative's signature on the training plan.

Which law the terms follow

The artifact is written for Victoria. The training contract, its approval and its probation and cancellation rules come under the Education and Training Reform Act 2006 (Vic) and are administered by the Victorian Registration and Qualifications Authority. The employment is in the national system, so the Fair Work Act 2009, the National Employment Standards and the Electrical, Electronic and Communications Contracting Award 2020 [MA000025] set wages and leave. Site safety duties come from the Occupational Health and Safety Act 2004 (Vic), named in clause 4.3.

What makes this document work

Four years on one table

The training plan sets each year's off the job blocks at Goldfields Trade Institute against the work on site, from safety and cable pulling in year 1 to verification and the licensed electrician assessment in year 4. The apprentice and parent can see the whole path before signing.

Wages that rise and cannot fall behind

$19.50, $23.10, $27.40 and $31.80 an hour, or $741.00 to $1,208.40 a week at 38 hours, each from an anniversary date. Clause 3.1 adds that the rate is never less than the award rate for the stage and age, and clause 2.3 allows earlier progression on competency.

Supervision is a rule, not a hope

Clause 4.1 names the supervising electrician and his licence number, clause 4.2 moves supervision from direct to general only as competency is assessed, and the apprentice never does live work at any stage. Clause 6.2 has the supervisor drive him to sites until he holds a full licence.

Questions people ask

Is an apprenticeship agreement the same as a training contract?

No. In Victoria the training contract is a separate document in the form the Victorian Registration and Qualifications Authority approves, lodged through an Apprenticeship Network Provider. It registers the apprenticeship. This agreement sets the employment terms around it, and clause 1.1 says the training contract prevails if the two ever differ.

Why does a parent sign an apprenticeship agreement?

Because the apprentice is under 18. In Victoria a parent or guardian must sign the training contract, and any change to it, for an apprentice under 18. Having the parent sign the employment agreement as well means they have seen the wages, hours and supervision terms, and know who to call if something goes wrong.

How are apprentice wages set?

By the modern award covering the work, here the Electrical, Electronic and Communications Contracting Award 2020, which sets minimum rates by year of apprenticeship and, for some apprentices, by age and schooling. An employer can pay more. This contract fixes rates by stage and says the award rate applies if it is ever higher.

What happens during the probation period?

During the probationary period recorded on the training contract, here three months, either the employer or the apprentice can cancel the training contract under the Authority's rules, and the employment ends with it. After probation, cancellation needs the process the Authority sets, which clause 7.2 begins with a meeting with the network provider.

Who pays for training and tools?

This employer pays the RTO course fees and does not recover them, supplies test instruments and power tools, and reimburses up to $600 of the first year hand tool kit. The award also sets tool and travel allowances for apprentices, which clause 3.2 says are paid on top of the hourly rate.
