Tutoring services agreement

This agreement is made on 25 January 2027 between Rania Haddad, trading as Bright Marks Tutoring, ABN 49 205 771 862, called the Tutor, and Michelle Tanaka of 22 Gordon Street, called the Parent, for the tutoring of Kai Tanaka, Year 10, in mathematics.

1. The sessions
1.1
When, where and how long
One session a week of 90 minutes, on Wednesday from 4.30 pm to 6 pm, at the Tanaka home with a parent or another adult present in the house. Sessions run through the school terms and stop over the school holidays unless the Parent books holiday sessions separately.
1.2
What each session covers
The first 15 minutes reviews the week's class work and any homework the student found hard, the next 60 minutes covers the current topic with worked problems, and the last 15 minutes sets practice for the week. Assessment weeks shift to past paper practice under timed conditions.
1.3
What tutoring is not
The Tutor does not complete, write or check assignments that will be submitted for assessment, and does not sit with the student during an online test. Helping a student understand a topic is tutoring; producing work the school will mark as the student's own is not, and the Tutor will decline it.
2. Progress and communication
2.1
The four week progress note
Every fourth session the Tutor sends the Parent a short written note covering the topics worked on, what the student can now do that they could not before, where they are still slipping, the marks of any assessment returned in that period, and what the Tutor plans for the next four weeks.
2.2
Talking to the school
The Tutor speaks with the student's mathematics teacher only if the Parent asks in writing, and then only about the topics being covered. Reports, assessment feedback and school records are shared with the Tutor by the Parent, not by the school.
3. The Tutor
3.1
Working with children check
The Tutor holds a current Working with Children Check, number WWC1180443E, and gives the Parent the number and expiry so the Parent can verify it online. The Tutor tells the Parent immediately if the check is ever suspended or not renewed, and does not tutor without a current one.
3.2
Conduct
Sessions happen in a common area of the home with an adult present in the house. The Tutor does not drive the student anywhere, does not contact the student on personal social media, and communicates about scheduling with the Parent rather than the student.
4. Fees, cancellations and makeup sessions
4.1
The rate and invoicing
The rate is $65 an hour, so a 90 minute session is $97.50. The Tutor invoices at the end of each month for the sessions held, listing each date, and payment is due within seven days. Travel is not charged within 10 kilometres of Marrickville. The Tutor is not registered for GST, so none is charged.

Cancellations and makeup sessions
A session cancelled with more than 24 hours notice is rescheduled at no cost to a time in the same fortnight, or credited if no time suits. Inside 24 hours, or a no show, the session is charged in full, except where the student is unwell, which is not charged the first two times in a term. A session the Tutor cancels is always made up or credited.
5. General
5.1
What is promised, privacy, and ending it
The services carry the consumer guarantees under the Australian Consumer Law, including due care and skill. No particular mark, band or ATAR is promised, because results depend on the student's own work as much as on the tutoring. Information about the student is kept confidential and used only for tutoring. Either party may end this agreement with two weeks written notice, and sessions already held are invoiced as usual. This agreement replaces anything discussed at the first meeting.

How to adapt this agreement

For online tutoring, delete the in home clauses and replace them with the platform used, a recording rule and a requirement that a parent can join at any time, which is what replaces having an adult in the house. For an adult student, drop the parent as a party, remove the working with children check clause and send the progress note to the student. For a tutoring business with several tutors, add a clause saying the business may substitute a tutor with equivalent qualifications on notice, and keep the check obligation on the business rather than the individual.

Which law the terms follow

Paid work with children requires a state working with children check, and this agreement puts the number and expiry in the letterhead and in clause 3.1 so the parent can verify it on the public register rather than take it on trust. Consumer guarantees under the Australian Consumer Law apply to the tutoring and cannot be excluded, which is why clause 5.1 states them alongside the honest statement that no particular result is promised. Information about the student is personal information and is used only for tutoring and kept confidential. The tutor is not registered for GST, so no GST is charged and none appears on the invoice, and the ABN is still shown.
