How to adapt this agreement
For online tutoring, delete the in home clauses and replace them with the platform used, a recording rule and a requirement that a parent can join at any time, which is what replaces having an adult in the house. For an adult student, drop the parent as a party, remove the working with children check clause and send the progress note to the student. For a tutoring business with several tutors, add a clause saying the business may substitute a tutor with equivalent qualifications on notice, and keep the check obligation on the business rather than the individual.
Which law the terms follow
Paid work with children requires a state working with children check, and this agreement puts the number and expiry in the letterhead and in clause 3.1 so the parent can verify it on the public register rather than take it on trust. Consumer guarantees under the Australian Consumer Law apply to the tutoring and cannot be excluded, which is why clause 5.1 states them alongside the honest statement that no particular result is promised. Information about the student is personal information and is used only for tutoring and kept confidential. The tutor is not registered for GST, so no GST is charged and none appears on the invoice, and the ABN is still shown.

Clause 2.1 asks for topics covered, what the student can now do that they could not before, where they are still slipping, the marks of any assessment returned, and the plan for the next four weeks. That is a note a parent can act on.
It refuses to do the student's assessment
Clause 1.3 says the tutor does not complete, write or check assignments that will be submitted for marking, and does not sit with the student during an online test. Drawing that line in the contract protects the tutor as much as the student.
The year is priced term by term
Ten sessions in each of terms one to three and nine in term four, at $97.50 a session, adding to 39 sessions and $3,802.50 for the school year. A parent can budget the whole year before the first session rather than watching invoices arrive.

Does a private tutor need a working with children check?
For paid work with children, yes, and the contract should name it so it can be verified. Clause 3.1 gives the number and expiry, requires the tutor to tell the parent immediately if it lapses, and prohibits tutoring without a current one.
How much does private tutoring cost?
This agreement runs at $65 an hour, which is $97.50 for a 90 minute session and $3,802.50 across the 39 session school year. Travel is not charged within 10 kilometres, and the tutor is not registered for GST so none is added.
What happens if a session is cancelled?
More than 24 hours notice and it is rescheduled at no cost within the same fortnight, or credited if no time suits. Inside 24 hours it is charged in full, except for illness, which is not charged the first two times in a term.
Should a tutor talk to the school?
Only if the parent asks in writing, and then only about the topics being covered. Clause 2.2 keeps reports and assessment feedback flowing from the parent to the tutor rather than from the school, which avoids privacy problems on both sides.
Can a tutor promise a better mark?
No honest one can, and clause 5.1 says so. Consumer guarantees require the service to be delivered with due care and skill, but results depend on the student's own work as much as on the tutoring, so no particular mark, band or ATAR is promised.
