1. The works
1.1
Scope
Strip and dispose of the existing terracotta tile roof and sarking over the whole dwelling, about 186 square metres, inspect and replace damaged battens and rafters against the allowance in clause 3.3, install new sarking, re roof in the tile named below, and renew the ridge and hip bedding and pointing throughout. Also included are new valley irons, new lead flashings to both chimneys and the two vent penetrations, reinstatement of the two whirlybirds, a gutter clean on completion, and removal of every tile and offcut in the Roofer's own skip.

Exclusions
Gutters and downpipes, fascia, the solar array removal and refit, ceiling repairs, painting, asbestos removal if any is found in the eaves lining, and structural work beyond the batten and rafter allowance. Each is quoted separately if the Owner wants it.

Materials and workmanship warranty
The materials in the table above are the ones priced, and a substitution is made only if a product is unavailable and only with the Owner's written agreement to an equal or better product. The Roofer warrants its own workmanship for 10 years from practical completion, covering leaks, lifted tiles, failed pointing and flashing failure caused by the way it was installed. Product warranties are the manufacturer's and the Roofer registers them in the Owner's name and hands over the paperwork.
3. Price and payment

Contract sum
The contract sum is $24,900 plus GST for the scope in clauses 1 and 2. It includes scaffolding, edge protection, the skip, all materials, labour and the site clean.

3.2
Claims and payment
Each stage is claimed by a payment claim stating that it is made under the Building Industry Fairness (Security of Payment) Act 2017 (Qld). The Owner pays the claim or gives a payment schedule saying why less is payable within the time that Act allows. No deposit is taken before work starts.
3.3
Batten and rafter allowance
An allowance of 30 battens and 4 metres of rafter repair is included. Anything beyond it is charged at $18 a batten and $110 a metre of rafter, photographed before it is covered, and approved by the Owner in writing before it is done. Unused allowance is not credited because it is already priced into the rate.
4. Weather, tarping and programme
4.1
Never more roof open than can be closed
The Roofer strips only the area it can sarken and batten the same day, and never leaves the dwelling open overnight. At the end of every working day the open area is either battened and sarked or fully tarped, with the tarp weighted and tied, not just laid over.
4.2
Rain
Work stops when rain is falling or forecast at 60 percent or more for the afternoon, and the roof is closed before the crew leaves. The Roofer checks the Bureau forecast each morning and tells the Owner by 7 am if the day is off. A rain day moves the programme by one day and is not a delay claim by either side. The programme is scaffold up 16 November, strip and sark to 19 November, tiling to 25 November, pointing and flashings to 27 November, and handover 1 December, working 7 am to 4 pm on weekdays.
4.3
Water entry
If water enters the dwelling during the works and the roof was not closed as clause 4.1 requires, the Roofer pays for the drying and the repair of any damage. If the roof was closed and an extreme event still drove water in, the Owner claims on its own building insurance and the Roofer assists with the report.
5. Safety and the site
5.1
Work at height
Work on the roof is high risk construction work, so the Roofer prepares a safe work method statement for it before starting, keeps it on site, and works to it. Edge protection or a harness system is in place whenever anyone is on the roof, and the scaffold is inspected and tagged before first use. The drop zone below the roof edge is barricaded while stripping and loading are happening, and the Owner keeps children and pets inside during working hours.
5.2
Insurance
The Roofer holds public liability cover of $20 million, workers compensation as required by law, and the statutory home warranty insurance for this contract, and gives the Owner the certificates before work starts. The Owner keeps its home building policy current through the works.
6. Handover, defects and ending
6.1
The last day, and the ten years after it
On the last day the Roofer walks the site with the Owner, cleans the gutters, runs a hose test over the valleys and both chimney flashings, and hands over the warranty paperwork, the product registrations and a photograph set of the battens and sarking before the tiles went on. A defect notified in the 10 year workmanship warranty period is inspected within five business days and rectified within 15, at the Roofer's cost, and the statutory warranties for domestic building work and the consumer guarantees under the Australian Consumer Law are not limited by this contract. Either party may end this contract if the other is in serious breach and has not fixed it within 10 business days of written notice, and the Roofer is then paid for work properly carried out and for materials on site. A payment dispute may go to adjudication under the security of payment legislation, anything else goes to the Queensland Building and Construction Commission before proceedings, and this contract is governed by the law of Queensland.

How to adapt this agreement

For a metal re roof, replace the tile and pointing rows with sheet profile, gauge, fixings and insulation blanket, and add a clause on thermal expansion and fixing pattern. For a repair or a restoration rather than a replacement, delete the strip scope and the batten allowance, and replace them with a defect list by location with a price against each, because a restoration is a list of small jobs rather than one big one. For a commercial roof, add roof access and permit requirements, a clause on working over an occupied tenancy, and progress claims against a programme instead of three stages.

Which law the terms follow

The job is in Queensland, so payment claims run under the Building Industry Fairness (Security of Payment) Act 2017 and the licence is a QBCC licence. Roof work is high risk construction work under the model work health and safety laws, which is why a safe work method statement is required before the job rather than written up afterwards.
