For a kitchen rather than a bathroom, swap the fixture rows for sink, dishwasher, fridge water point and gas cooktop connection, and add a gas compliance line if a gas fitter is involved. For a repair call out rather than a renovation, delete the fixed price and the stage table, keep the hourly rates and add a call out fee and a diagnosis step before any work is approved. For a commercial fitout, replace the statutory domestic warranties with a defects liability clause, add a progress claim clause under the state security of payment legislation, and raise the public liability cover to match the head contractor's requirement.
Which law the terms follow
The job is in Queensland, so the compliance certificate is the one a licensed plumber lodges for notifiable work and the licence is a QBCC licence. Statutory warranties for domestic building work under the Queensland Building and Construction Commission Act 1991 apply on top of anything the contract says, and clause 5.2 states that rather than trying to contract around them. Consumer guarantees under the Australian Consumer Law apply to the goods and services and cannot be excluded. GST is added at 10 percent and shown separately on an invoice carrying the ABN and the licence number, and a dispute can go to the Commission before anyone starts proceedings.
