Parties

This agreement is made on 2 October 2026 between Halvard Hospitality Pty Ltd, ABN 71 336 905 224, of 4 Rye Lane, Brunswick VIC 3056, called the Client, and Voltwise Electrical Pty Ltd, ABN 28 550 771 306, Registered Electrical Contractor licence REC 24118, of 22 Dawson Street, Coburg VIC 3058, called the Contractor.

1. The works
1.1
Scope
A full rewire of the tenancy at 4 Rye Lane and the electrical fitout of the new kitchen and counter, carried out to AS/NZS 3000 and the drawings listed in clause 1.2. The tenancy trades through the works, so power to the existing front of house is kept live except during the two agreed shutdowns.
1.2
Drawings
The works are those shown on drawings E-01 switchboard and submains, E-02 power and data layout, E-03 lighting layout and E-04 kitchen equipment schedule, all revision C dated 18 September 2026. Where a drawing and this agreement disagree, this agreement prevails.
1.3
Exclusions
Data and telephone cabling, the fire panel, the refrigeration mechanical work, the supply authority connection fee, patching and painting after chasing, and any asbestos found in the existing ceiling. Each is either by others or quoted separately.
1.4
Licensed work only
All electrical installation work is carried out by or under the supervision of a licensed electrician, and the Contractor holds and keeps current its Registered Electrical Contractor registration for the whole of the works. The registration number appears on every invoice and on the certificate issued under clause 5.
2. Price and payment
2.1
Contract sum
The contract sum is $38,600 plus GST, fixed for the scope in clause 1. It includes all labour, materials, the switchboard, testing, the certificate and one return visit for commissioning after the kitchen equipment lands.

2.2
Progress claims
Each stage is claimed by a payment claim that states it is made under the Building and Construction Industry Security of Payment Act 2002 (Vic). The Client pays the claimed amount or issues a payment schedule saying why less is payable, within 10 business days of the claim. Payment is due within 15 business days of a valid claim. No retention is held, but stage 3 is not claimable until the certificate under clause 5 is in the Client's hands and the defects list from the walkthrough is cleared or agreed in writing.
A payment schedule is not optional
If the Client wants to pay less than a payment claim asks for, it has to say so in a payment schedule inside the time allowed and give reasons. Staying silent is not a defence later, which is why clause 2.2 sets the deadline in business days rather than as soon as practicable.
3. Variations
3.1
In writing, before the work
A variation is priced and agreed in writing, including by email, before the work is done. Work carried out without a written variation is not payable, and the Contractor does not proceed on a verbal instruction from anyone on site.

Concealed conditions
The existing ceiling and wall cavities have not been opened. If the Contractor finds unsafe existing wiring, asbestos or a structural obstruction, it stops that part of the work, tells the Client the same day, and prices the extra as a variation before continuing.
4. Programme, site and safety
4.1
Programme and shutdowns
On site from 19 October, rough in complete by 6 November, fit off complete by 27 November, commissioning by 4 December. The two power shutdowns are booked for Monday 26 October and Monday 23 November, each from 6 am to 11 am, and are confirmed with the Client five business days ahead.
4.2
Site and safety
The Client gives clear access to the tenancy, the meter room and the roof space during working hours and keeps the area free of stock during the shutdowns. The Contractor works under the Occupational Health and Safety Act 2004 (Vic), prepares a safe work method statement for any high risk work including work at height and live testing, and isolates and tags every circuit it works on. No one else works in an isolated area while a tag is on.
5. Certificate and handover
5.1
Certificate of Electrical Safety
Within five business days of completing the works the Contractor tests the installation and issues a Certificate of Electrical Safety for the prescribed work, with the results of the mandatory tests recorded on it. The Client cannot be asked to pay stage 3 before it has that certificate.
5.2
What is handed over
A marked up as built copy of E-01 to E-04, the switchboard schedule with every circuit labelled, the test results, the manuals and warranty cards for the light fittings and the switchgear, and a written list of which circuits feed which kitchen equipment.
6. Defects and warranties
6.1
Defects period
The defects period is 12 months from the date on the certificate. A defect notified in that period is attended within two business days and rectified within ten, at the Contractor's cost, including making good any surface it has to open.

7.1
Certificates and suspension
Each party gives the other a certificate of currency for its policies before work starts and within five business days of any renewal during the works. If a payment is more than 10 business days late and no payment schedule was issued, the Contractor may suspend the works on two business days written notice and is entitled to the reasonable cost of demobilising and returning.
7.2
Ending the agreement
Either party may end this agreement if the other is in serious breach and has not fixed it within 10 business days of written notice, or becomes insolvent. On termination the Contractor is paid for work properly carried out to that date, including materials already on site.
7.3
Disputes
The parties meet within five business days of a dispute being raised. A payment dispute may go to adjudication under the security of payment legislation at any time. Anything else goes to mediation before proceedings, and this agreement is governed by the law of Victoria.

For a domestic rewire rather than a commercial fitout, replace the drawing list with a room by room scope, drop the trading hours and shutdown clauses, and add the statutory home building warranties that apply to residential work in your state. For a maintenance arrangement rather than one job, replace the staged payment table with a call out fee and an hourly rate, and swap the defects period for a response time. For a job under the threshold where security of payment does not help, cut clause 2.2 back to a plain 14 day term and keep the rest, because the certificate link in clause 5.1 is doing most of the work.
