Breach notice, unpaid rent, 7 Coolibah Way, Bayswater
Breach notice template for unpaid rent with 14 days to remedy
A breach notice template tells a tenant which term of the tenancy agreement they have broken, what evidence shows it, what they must do to fix it and by when. In Western Australia a rent breach is notified on the prescribed Form 21, so this letter goes with that form and sets out the detail the form leaves to the landlord.

How to adapt this document
For a breach other than rent, such as an unapproved pet or damage, use the general breach notice form for that state, describe the breach in one sentence with the date it was found, list photos or reports as evidence, and state the remedy as a physical action with a date. For weekly or fortnightly rent, replace the monthly figures and list each missed due date in the evidence table. For a property managed by an agent, put the agency letterhead and licence on the notice and sign as agent for the owner.
Which law the terms follow
The artifact is written for Western Australia under the Residential Tenancies Act 1987 (WA), as amended in 2024, and its regulations. Form 21 is the breach notice for non payment of rent and allows 14 days to pay; Form 1A then gives 7 days to vacate if the breach is not remedied, and only the Magistrates Court can make a termination order. Consumer Protection at the Department of Local Government, Industry Regulation and Safety publishes the forms and guidance this letter follows.
What makes this document work
The breach is a clause and a date
Clause 3 of the agreement dated 1 March 2026 requires $2,520 a month in advance on the 16th, and the rent due on Wednesday 16 September 2026 is unpaid. Naming the clause and the missed due date makes the breach specific enough for a tribunal or court to check against the agreement.
Evidence that a magistrate would accept
The ledger shows six on time payments from 16 March and none in September, the bank statement shows no deposit since 15 August, and two reminders on 18 and 24 September went unanswered. Each row is a document the landlord could produce if the matter went further.
The remedy is achievable and the alternative is offered
Pay $2,520 by Friday 16 October 2026, 14 days from the notice, into a stated account with a reference, or contact the landlord before then to agree a written repayment plan. The consequence, Form 1A with 7 days to vacate, follows only if neither happens.
Questions people ask
What is Form 21 in Western Australia?
Form 21 is the prescribed breach notice for non payment of rent under the Residential Tenancies Act 1987 (WA), updated in July 2024. It gives the tenant 14 days to pay the overdue rent. This letter is attached to the signed form and says plainly that it does not replace it.
What happens if the rent is still unpaid after 14 days?
The landlord can give a notice of termination for non payment of rent on Form 1A, which gives the tenant 7 days to vacate. If the tenant does not leave, the landlord applies to the Magistrates Court for a termination order. The tenancy can be saved by paying all arrears or keeping to an agreed repayment plan.
Is a breach notice the only way to deal with unpaid rent in WA?
No. A landlord can instead give Form 1B, a notice of termination for non payment of rent without a prior breach notice. The breach notice route used here gives the tenant 14 days to put things right first, which is fairer when the tenant has a good payment history, as this one does.
How should a breach notice be delivered?
In a way that can be proved later, such as by hand, as this one was on Friday 2 October 2026, or by post, allowing extra days for delivery. Keep a copy of the signed form and this letter, and a note of the time and manner of delivery, with the rent ledger.
Should the landlord offer a repayment plan?
It is often the quickest way to recover the money and keep a good tenant. Under the WA rules, a tenant who keeps to an agreed repayment plan can remain in the home. Put any plan in writing, with dates and amounts that add up to the arrears, and keep the next rent payments separate from it.
Can the landlord charge a late fee or interest?
Only if the tenancy agreement allows it and the amount is lawful under the Act and regulations. This notice asks only for the unpaid rent of $2,520, which keeps the remedy simple and avoids an argument about extra charges that could delay payment of the rent itself.

Rent increase notice template with the new amount and 60 days notice
A rent increase notice template tells a tenant the new rent and the date it starts, in writing, with at least the notice the law requires. In New South Wales that is 60 days, the notice must state the new amount rather than only the increase, and rent can go up only once in 12 months, so the notice has to show all three.
Landlord notice to vacate template for the sale of the property
A landlord notice to vacate template ends a tenancy in writing, giving the ground, the notice period and the date the tenants must leave. Since May 2025 a New South Wales landlord can only end a tenancy on a listed ground, so the notice has to name it, give the right period for the type of agreement and attach the evidence the ground requires.
Bond claim letter template with itemised deductions
A bond claim letter tells a former tenant how much of their bond the landlord is claiming, for what, with what evidence, and how much comes back to them. Sending it before lodging the claim gives the tenant a chance to agree, which in New South Wales means a joint claim and a faster refund, or to dispute it with the Tribunal.
