Termination notice, proposed sale, 23 Lilly Pilly Avenue, Penrith

Landlord notice to vacate template for the sale of the property

A landlord notice to vacate template ends a tenancy in writing, giving the ground, the notice period and the date the tenants must leave. Since May 2025 a New South Wales landlord can only end a tenancy on a listed ground, so the notice has to name it, give the right period for the type of agreement and attach the evidence the ground requires.

How to adapt this document

For a contract for sale that has already been exchanged, change the ground to sale of the property, reduce the period to 30 days and enclose the parts of the contract showing the buyer, the settlement date and that vacant possession is required. For a fixed term agreement, check whether it is over or under six months and that the end date is not before the term ends unless the ground allows it. For an agent giving the notice, use the agency letterhead and sign as agent for the landlords.

Which law the terms follow

The artifact is written for New South Wales under the Residential Tenancies Act 2010 (NSW) as amended from 19 May 2025, which requires a listed ground for every landlord termination, sets the notice periods by ground and agreement type, requires the termination information statement and supporting documents, and bars renting the premises out again for 6 months after a proposed sale termination. Bonds are held by NSW Fair Trading and released through Rental Bonds Online, and the NSW Civil and Administrative Tribunal hears termination applications.

What makes this document work

The ground is one the law lists

Proposed sale of the premises with vacant possession, stated in the opening paragraph and again in the table. A NSW landlord cannot end a tenancy without a ground any more, so the notice names it in the words the rules use rather than a general explanation.

The period fits the agreement type

The agreement has been periodic since the fixed term ended on 31 July 2026, so the period for a proposed sale is 90 days. Given in person on Monday 5 October 2026 with an end date of Tuesday 5 January 2027, the notice gives 92 days and says so.

The evidence and the consequences travel with it

The table lists the termination information statement and a copy of the agency agreement with Westridge Realty, the evidence a proposed sale needs. The paragraph below states the 6 month bar on renting it out again, and the list explains the final inspection and the $2,400 bond.

Questions people ask

Can a NSW landlord end a tenancy without a reason?

Not since 19 May 2025. A landlord must use one of the grounds the Residential Tenancies Act lists, such as sale of the property, significant renovations, the landlord or family moving in, or a breach. This applies to all tenancies, including those that began before that date, so every termination notice now has to state its ground.

How much notice is needed to end a lease for a sale in NSW?

For a proposed sale with vacant possession, 60 days for a fixed term of six months or less, and 90 days for a fixed term over six months or a periodic agreement. Once a contract for sale requiring vacant possession has actually been signed, the period is 30 days for any agreement.

What documents must go with the notice?

A termination information statement, and for a proposed sale, a copy or partial copy of the agency agreement showing the parties, the property, the agent's licence number and the term. For an actual sale, the relevant parts of the contract showing vacant possession is required. This notice lists both enclosures in its table.

Can the landlord rent the property out again after using the sale ground?

Not for 6 months after the termination date, if the ground was a proposed sale. That rule stops the ground being used to replace one tenant with another at a higher rent. The notice states it, which helps the tenants trust that the reason is genuine.

What if the tenants do not leave by the date?

The landlord can apply to the NSW Civil and Administrative Tribunal for a termination order. The landlord must not change the locks or remove belongings to force a tenant out. Most tenants leave on time when the notice is clear and early, and a tenant who finds a place sooner can discuss an earlier date.

How should the notice be given?

In person, by post allowing extra working days for delivery, by email to an address the tenant has given for notices, or in an envelope in the mailbox. This one was handed over on Monday 5 October 2026, which makes the start of the notice period easy to prove.
