Three shapes, not twenty one documents

Occupation agreements hand over a space for a time: residential and retail leases, subleases, holiday rentals, storage units, farm leases, venue hire, licences to occupy and agistment. Their weight sits in rent, bond, term, condition and what happens at the end. Transfer agreements move ownership outright, which is the boat, motorcycle, caravan, vehicle, equipment, animal and artwork sales, and their weight sits in identifying the thing precisely, in warranties of title and in the moment risk passes. Between them sit the staged deals, rent to own, options to purchase and consignment, where possession moves first and ownership moves later or not at all.

Picking the right one

Start with whether ownership is changing. If it is not, you are in the occupation group and the next question is exclusivity: a lease grants exclusive possession, a licence to occupy deliberately does not, and choosing wrongly changes the tenant's statutory rights. If ownership is changing, the next question is whether money arrives all at once, because a sale on terms needs the security and default wording a plain sale does not carry. Where the goods are financed, the agreements name the register that has to be searched before settlement, since a buyer who skips that step can lose the asset to a prior security interest.

What to check before you use one

Residential tenancy is prescribed by statute in every Australian state, so the residential examples here name their state and cover situations the prescribed form does not, rather than pretending to replace it. Every party name, ABN, registration number, bond figure and licence number in these documents is invented, so replace all of them. Clause by clause wording for the payment, liability, termination and intellectual property sections lives in the clause collections, which go into variants and negotiation points further than a finished agreement can.

  A private bike sale is usually settled in a driveway with a bank transfer and a handshake, and that is exactly when the roadworthy certificate and the finance search get skipped. This agreement records both before the money moves, along with the two numbers that decide whether the bike is what the advertisement said it was.

  An option to purchase buys time rather than land. The grantee pays a fee for the exclusive right to buy at a fixed price within a set window, and can walk away without buying anything. This one gives a developer 18 months over a 3.4 hectare block at Woodford for $25,000, at a fixed price of $1,400,000.

  A puppy contract has two jobs: to record what the buyer is getting on the day, and to say what happens years later when life changes. This one puts the microchip, the source number and the vaccination dates in a table, gives 72 hours for a vet to look, and commits the breeder to take the dog back at any age rather than see it advertised online.

  A rent to own agreement is a hire with an option to buy at the end, so the goods stay with the supplier until the last payment.
